Welcome to Magic Pour. These Terms of Service govern your access to and use of our website, products, services, checkout pages, advertisements, emails, text messages, product pages, and any other online or offline interactions with Magic Pour. By visiting our website, placing an order, submitting payment information, contacting customer support, or using any Magic Pour product, you agree to be bound by these Terms of Service, our Return & Refund Policy, Shipping Policy, Privacy Policy, and any other policies posted on our website.
Please read these Terms carefully before purchasing. If you do not agree with these Terms, you should not use our website or purchase from us.
1. Brand Ownership
Magic Pour, including our name, product names, logos, images, product descriptions, website content, graphics, videos, advertisements, packaging concepts, slogans, written copy, and other brand materials, belongs to Magic Pour or its respective owners.
You may not copy, reproduce, edit, resell, modify, imitate, distribute, scrape, publish, upload, use in advertisements, or commercially exploit our brand materials without written permission from Magic Pour.
Unauthorized use of our brand name, product photos, product descriptions, website layout, advertising copy, or other materials may result in legal action, takedown requests, account reports, or other enforcement measures.
2. Product Use
Magic Pour products are intended for ordinary household use only. Customers are responsible for reading all product descriptions, usage instructions, warnings, and compatibility notes before purchasing and before using the product.
Magic Pour is designed to help dispense compatible beverages from compatible containers. Product fit and performance may vary depending on bottle size, bottle opening, container shape, liquid thickness, installation method, battery condition, and user handling.
By purchasing, you acknowledge that the product may not fit every bottle, jug, carton, container, or beverage type.
3. No Guarantee of Compatibility
Magic Pour does not guarantee universal compatibility with every beverage container. Differences in bottle openings, cap designs, thread sizes, bottle materials, liquid viscosity, refrigerator spacing, and storage position may affect product use.
A product not fitting a specific customer-owned container is not automatically considered defective. Customers are responsible for reviewing product information before purchase and determining whether the product is suitable for their intended use.
4. Orders and Acceptance
Placing an order does not guarantee acceptance of that order. We reserve the right to accept, reject, cancel, limit, hold, or review any order at any time for any reason, including suspected fraud, payment issues, inventory limitations, supplier delays, pricing errors, shipping restrictions, abuse of promotions, or violation of these Terms.
If an order is canceled after payment has been collected, we may issue a refund to the original payment method, unless otherwise restricted by fraud review, chargeback activity, or payment processor rules.
5. Accurate Customer Information
Customers are responsible for providing complete and accurate order information, including name, email address, shipping address, billing address, phone number, apartment number, and payment details.
Magic Pour is not responsible for delays, lost packages, failed deliveries, or additional costs caused by incorrect, incomplete, outdated, or undeliverable customer information.
If a customer provides the wrong shipping address and the order is shipped, the customer remains responsible for the purchase.
6. Payment Authorization
By placing an order, you confirm that you are authorized to use the payment method provided. You agree that all information submitted during checkout is accurate and truthful.
Fraudulent purchases, unauthorized payment use, false billing details, chargeback abuse, or attempts to obtain products without valid payment may result in order cancellation, restriction from future purchases, reporting to payment processors, and other action available to us.
7. Pricing and Promotions
Prices, discounts, promotional offers, bundles, shipping offers, and product availability may change at any time without notice. We reserve the right to correct pricing errors, typographical errors, product description errors, and checkout errors.
If a product is listed at an incorrect price due to an error, we reserve the right to cancel or refuse the order, even if payment has already been submitted.
Promotional offers may be limited by quantity, customer, household, address, time period, or other conditions determined by Magic Pour.
8. Shipping and Delivery
Shipping times are estimates only and are not guaranteed unless expressly stated in writing. Processing and delivery times may vary due to supplier availability, warehouse delays, carrier delays, weather, holidays, customs, high order volume, incorrect addresses, or other circumstances outside our control.
Tracking information may be provided when available, but tracking is not guaranteed for every shipment. Some orders may have limited tracking updates or delayed tracking visibility depending on the carrier, fulfillment partner, or shipping method.
Once an order is shipped, the carrier is responsible for delivery. Magic Pour is not responsible for stolen packages, carrier delays, packages marked delivered, missed delivery attempts, packages delivered to the address entered by the customer, or packages lost due to incorrect customer information.
9. Package Marked Delivered
If carrier information shows that a package was delivered to the shipping address provided at checkout, the order may be considered fulfilled.
Magic Pour is not responsible for porch theft, mailbox theft, packages accepted by household members, packages accepted by neighbors, packages accepted by apartment offices, or packages misplaced after delivery.
Customers are responsible for contacting the shipping carrier for delivery-related issues after the package is marked delivered.
10. Returns and Refunds
All returns, exchanges, refunds, replacements, and order issues are governed by our Return & Refund Policy.
Due to hygiene and product quality reasons, Magic Pour does not accept general returns after a product has been opened, used, installed, exposed to liquid, damaged by the customer, or removed from its original packaging.
Return or refund requests are only reviewed for clear, valid, and verifiable issues such as damaged items, defective items, wrong items, or missing items.
Customers must contact us within forty-eight (48) hours of delivery and provide clear, well-lit photos of the product, packaging, shipping label, and claimed issue. Blurry, incomplete, cropped, late, or unclear photos may result in denial of the request.
Approval of any return, refund, replacement, or store credit is not guaranteed.
11. Final Sale Items
Unless required by law or approved by Magic Pour, all used, opened, installed, liquid-exposed, altered, damaged, clearance, promotional, discounted, or final sale items are not eligible for return or refund.
Buyer’s remorse, change of mind, personal preference, failure to read product details, incorrect assumptions, bottle incompatibility, delayed shipping, minor packaging differences, or customer misuse are not valid reasons for refund.
12. Product Images and Packaging
We try to display product images, colors, features, and packaging accurately. However, product images are for illustration and marketing purposes. Packaging, colors, labels, accessories, minor design details, and presentation may vary depending on inventory, supplier updates, manufacturing changes, or fulfillment availability.
Minor variations in packaging or presentation do not mean the product is defective or materially different.
13. Customer Misuse
Magic Pour is not responsible for damage, leaks, spills, malfunction, injury, mess, property damage, or product failure caused by misuse, improper installation, failure to follow instructions, use with incompatible containers, use with unsuitable liquids, poor cleaning, dropping the product, forcing parts together, modifying the product, or using the product outside its intended purpose.
Customers are responsible for using the product safely and appropriately.
14. No Warranties
To the fullest extent permitted by law, Magic Pour products and website are provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee that the product will meet every customer’s personal expectations, fit every container, prevent every spill, work with every beverage, or produce any particular result.
We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted website operation, to the fullest extent permitted by law.
15. Limitation of Liability
To the fullest extent permitted by law, Magic Pour, its owner, employees, contractors, suppliers, fulfillment partners, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to the website, products, shipping, delays, product use, product misuse, customer expectations, payment issues, returns, or third-party services.
Our maximum liability for any claim shall not exceed the amount paid by the customer for the specific product giving rise to the claim.
16. Assumption of Risk
By purchasing and using Magic Pour, you voluntarily assume all risks associated with product installation, product handling, beverage dispensing, storage, cleaning, use around children, use in refrigerators, use near electronics, and use with customer-owned containers.
Customers are responsible for determining whether the product is appropriate for their household and intended use.
17. Chargebacks and Payment Disputes
Customers agree to contact Magic Pour first before filing a chargeback or payment dispute. We reserve the right to provide payment processors with order details, tracking information, delivery confirmation, customer communications, product policy disclosures, photos, and other evidence in response to disputes.
False claims, chargeback abuse, duplicate refund attempts, or attempts to keep a product while recovering payment may result in restriction from future purchases and additional action available to us.
18. User Content and Reviews
If you submit a review, testimonial, photo, video, comment, message, social media post, or other content related to Magic Pour, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, display, edit, publish, share, and distribute that content for marketing, advertising, website, and business purposes.
You confirm that any content you submit is truthful, original, and does not violate the rights of any third party.
We reserve the right to remove, reject, edit, or refuse user content at our discretion.
19. Prohibited Conduct
You agree not to use our website or products for unlawful, abusive, fraudulent, or harmful purposes. You may not:

- File false refund claims

Unauthorized copying of our product page, brand assets, photos, videos, product name, descriptions, or advertisements may result in DMCA notices, platform complaints, takedown requests, legal action, or other enforcement steps.
22. Indemnification
You agree to defend, indemnify, and hold harmless Magic Pour, its owner, affiliates, contractors, suppliers, partners, and service providers from and against any claims, damages, losses, liabilities, costs, expenses, or attorney’s fees arising from your use of the website, your purchase or use of our products, your violation of these Terms, your misuse of the product, your submitted content, your violation of another party’s rights, or your violation of any law.
23. Force Majeure
Magic Pour shall not be responsible for delays, interruptions, or failures caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, carrier delays, supplier delays, labor disputes, pandemics, government actions, customs delays, internet outages, technical failures, payment processor issues, inventory shortages, or supply chain disruptions.
24. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law rules, unless otherwise required by applicable consumer law.
By purchasing from Magic Pour, you agree that any dispute shall be handled in Texas courts or another venue determined by applicable law.
25. Dispute Resolution
Before filing any legal claim, chargeback, complaint, or dispute, you agree to contact Magic Pour and attempt to resolve the issue in good faith.
Most issues can be resolved by contacting customer support with your order number, explanation, and required documentation.
26. Severability
If any section of these Terms is found to be invalid, unlawful, or unenforceable, the remaining sections shall continue in full force and effect.
